1. Informed Consent and Authorization

The following Statement of Patient Responsibility; Informed Consent and Authorization sets forth the terms under which Tarak Online Health Services, LLP (“TarakHealth”) is supplying you access to telephonic or electronic consultation services with a India-licensed/ registered  Physician and other practitioners and your agreement to accept responsibility for your decision to seek these services through TarakHealth.

In order to determine your compliance with these Terms, we reserve the right, but not the obligation, to monitor your access to and the use of the site and the Services. TarakHealth may, in its sole discretion, refuse to provide access to the site or services due to actual or potential misuse of the site, these Services, or for noncompliance with these Terms.

To fill any service requests, you must verify that you have read and understand these conditions, including the Statement of Patient Responsibility.

2. Statement of Patient Responsibility

In submitting my health information (symptoms, conditions, comments, answers to questions, and fully-completed Health Information Form) in connection with my request for services, the following statements are true:

  • I am an adult (at least 21 years of age).
  •  I am competent to use the services offered by TarakHealth, and I fully understand the material contained on this website.
  •  I voluntarily choose to seek a physician consultation through TarakHealth.
  •  I recognize that the consulting physician reviewing my Health Information may or may not prescribe treatment based on my responses.
  •  I am aware that my failure to provide truthful, accurate and complete information to the consulting physician and any other providers could result in an inappropriate treatment decision that could be harmful to me or not be safe and effective. Therefore, I have responded to each question in the tele-consultation truthfully and accurately and have fully and completely disclosed any and all information concerning my health and medical history that could be relevant to my current condition and need for treatment and/or medication.
  •  I have been seen by a physician and have had a physical examination and/or medical history evaluation within one year of requesting services from TarakHealth. I agree to undergo a physical examination every year to ensure that my request for treatment is appropriate, and to inform my personal physician about the products ordered or purchased, as applicable,
  • I will contact my physician if I have questions, difficulties or complications with recommended
  •  I will make the Consulting Physician aware of any changes to my medical condition in the event I return to the site seeking services or products of any kind whatsoever.
  •  I understand that TarakHealth receives an electronic transmission of my request for a consultation for his/her response in accordance with the consulting physician’s professional judgment as to my request.
  •  I understand that I will be given the opportunity to the consulting physician any and all questions about any tests, procedures or medication(s) that may have been prescribed for
  •  I understand that the Consulting Physician is an independent, India registered / licensed practitioner; is not an employee or principal of TarakHealth and may or may not be my primary care physician.
  •  I understand that there are risks as well as benefits in having tests performed or taking any
  • If paying by credit or debit card, I am the owner of that credit or debit card or I am permitted by law to use such credit card.

3. Patient Agreement and Acknowledgement:

As a customer or potential customer of the services provided by or through this website or app, I hereby understand, accept, and agree to the following:

  • In order to determine your compliance with these Terms, we reserve the right, but not the obligation, to monitor your access to and the use of the site and the Services. TarakHealth may, in its sole discretion, refuse to provide access to the site or services due to actual or potential misuse of the site, these Services, or for noncompliance with these Terms.
  • I am voluntarily providing my health and medical information for the purposes of obtaining services through TarakHealth.
  •  I realize that the consulting physician will not conduct an in-person physical examination in telephonic consultation  and will rely on the truthfulness and accuracy of the information I am providing on a telephone and supplemented by answers to follow-up questions.
  • I am using this technology platform because I am seeking access to medical advice and treatment from a qualified physician and/or other clinician.
  •  I understand that a physician who is currently licensed/registered in India will review my health Information. Therefore, I agree that all telephonic or online consultations, diagnoses, and treatments will be deemed to have occurred in the state where the consulting physician is licensed to practice medicine.
  •  I am under the care of a personal physician and I do not consider the consulting physician to be my personal primary care physician.
  •  I acknowledge that TarakHealth does not practice medicine and is not a healthcare services provider. I further acknowledge that TarakHealth cannot and does not direct, control or influence the medical opinions or decisions made by the consulting physician or other assigned clinician with respect to my care.
  •  I agree that any dispute arising out of or related to the provision of services by TarakHealth, by the consulting physician or other clinician, or by their affiliates, employees, partners and agents, will be subject to mandatory mediation. Should mediation fail to resolve the dispute issue(s), said dispute shall be subject to final and binding arbitration and that all parties will agree to be bound by the arbitration, which will be enforceable in a court and that the parties waive any rights to bring suit in favor of agreeing to binding arbitration.
  •  Any mediation, arbitration, administrative proceedings, or other proceedings shall be held in Mumbai, Maharashtra, unless the parties agree otherwise, and shall be governed by the substantive law of Maharashtra / India  without regard to conflicts of law.
  •  I accept all risks, known and unknown, involved in, arising from or related to taking the medication, products or treatment. Subject to and without waiving any rights that may be conferred upon me under state or Indian law, I will not seek indemnification and/or damages whatsoever of any kind from TarakHealth for negligent, reckless or intentional acts or omissions, and I hereby hold harmless TarakHealth from and against any and all liability relating to or arising out of my request for or receipt of medications through TarakHealth.
  •  I hereby release TarakHealth and the consulting physician and other clinician from any and all claims that the physician acted below the requisite standard of care on the basis that the physician did not personally examine me.
  • I hereby acknowledge that all information and service provided by or through this web site or app are provided "as is" without warranty of any kind, expressed or implied.
  • If any provision of this agreement is held to be illegal, void or unenforceable, then this agreement may be modified or amended only to the extent necessary to enable the remaining provisions to be of force and effect to the maximum degree.

4. Patient Authorization for Release of Individually Identifiable Health Information

In connection with providing certain individually identifiable health information to TarakHealth,  I authorize the following:

  •  I hereby authorize TarakHealth to use and disclose any of my health information, including all individually identifiable health information obtained in the tele-consultation for the purpose of treatment, payment and health care operations. This authorization additionally includes, but is not limited to, any health information relating to HIV and other sexually transmitted diseases, mental health or disease, drug or alcohol treatments.

TarakHealth’s privacy notice, provides more detailed information about our privacy policies, and
you are encouraged to review it before agreeing to this authorization.

I declare under penalty of perjury that the foregoing is true and correct. My agreement to this statement constitutes my signature.


Statement of Patient / Customer Privacy

 This privacy policy is published in compliance of:

i. Section 43A of the Information Technology Act, 2000;

ii. Regulation 4 of the Information Technology (Reasonable Security Practices and

Procedures and Sensitive Personal Information) Rules, 2011 (the “SPI Rules”);

iii. Regulation 3(1) of the Information Technology (Intermediaries Guidelines) Rules,

This privacy policy states the following:

i. The type of information collected from the visitors of the Website or App and the

End users, including sensitive personal data or information;

ii. The purpose, means and modes of usage of such information; and

iii. How and to whom TarakHealth will disclose such information.

What is personal information?

1. “Personal information” is defined under the SPI Rules to mean any information that relates to a natural person, which, either directly or indirectly, in combination with other information available or likely to be available with a body corporate, is capable of identifying such person.

2. The SPI Rules further define “sensitive personal data or information” of a person to mean

personal information about that person relating to:

  • passwords
  • financial information such as bank accounts, credit and debit card details or other payment instrument details;
  • physical, physiological and mental health condition;
  • sexual orientation;
  • medical records and history;
  • biometric information;
  • information received by body corporate under lawful contract or otherwise;
  • visitor details as provided at the time of registration or thereafter; and
  • call data records.

3. Information that is freely available in the public domain or accessible under the Right to Information Act, 2005 or any other law will not be regarded as sensitive personal data or information.

The following Privacy Statement sets forth the protection of information related to the services and/or product(s) you may request.  To provide services and/or fill your requested order, you verify that you have read and understand these conditions.

6. Privacy Statement

A. All Users Note:

1. This section applies to all Users (“Users”).

2. Accordingly, a condition of each User’s use of and access to the Website and App and to the Software provided by TarakHealth to Users (together with the Website, the “Services”) is their acceptance of the terms of use, which also involves acceptance of the terms of this privacy policy. Any User that does not agree with any provisions of the same is required to leave the website immediately.

3. As part of the processing of your order through TarakHealth, you will be asked to provide certain individually identifiable personal information, including your name, email and mailing address, telephone number, billing information (including your credit card number or checking account information), in addition to other information to facilitate the ordering, billing, or payment process.
This information is maintained in a secure encrypted form and is not given, sold, traded, or otherwise provided to third parties unless legally required. Individually identifiable health information provided on the medical consultation will not be released other than to the pharmacy or to the subscriber or the subscriber’s authorized representatives or designated agent. User is advised, however, that internet technology is not 100% safe and User should exercise discretion on using the same.

4. Always use caution when giving out any personally identifiable information about yourself or your family members in use of any Services. TarakHealth does not control or endorse the content, messages or information found in any Services and, therefore, TarakHealth specifically disclaims any liability with regard to the Services and any actions resulting from your participation in any Services, and you agree that you waive any claims against TarakHealth relating to same, and to the extent such waiver may be ineffective, you agree to release any claims against TarakHealth relating to same.

5. All the information provided to TarakHealth by a User, including sensitive personal information, is voluntary. User has the right to withdraw his/her/its consent at any time, in accordance with the terms of this privacy policy and the terms of use, but please note that withdrawal of consent will not be retroactive. TarakHealth does not control or endorse the content, messages or information found in any Services and, therefore, TarakHealth specifically disclaims any liability with regard to the Services and any actions resulting from your participation in any Services, and you agree that you waive any claims against TarakHealth relating to same, and to the extent such waiver may be ineffective, you agree to release any claims against TarakHealth relating to same.

6.10 This privacy policy applies to Services that are owned and operated by TarakHealth. TarakHealth does not exercise control over the sites displayed as search results or links from within its Services. These other sites may place their own cookies or other files on the Users’ computer, collect data or solicit personal information from the Users, for which TarakHealth is not responsible or liable. Accordingly, TarakHealth does not make any representations concerning the privacy practices or policies of such third parties or terms of use of such websites, nor does TarakHealth guarantee the accuracy, integrity, or quality of the information, data, text, software, sound, photographs, graphics, videos, messages or other materials available on such websites. The inclusion or exclusion does not imply any endorsement by TarakHealth of the website, the website's provider, or the information on the website. TarakHealth encourages the User to read the privacy policies of that website.

6. User can access, modify, correct and eliminate the data about him/her/it which has been collected pursuant to his/her/its decision to become a User. If User updates any of his/her/its information, TarakHealth may keep a copy of the information which User originally provided to TarakHealth in its archives for uses documented herein. TarakHealth takes User’s rights seriously and encourages User to use them if User deems this to be appropriate. User may exercise these rights by emailing TarakHealth at Arogyam360@gmail.com.

7. Due to the communications standards on the Internet, when a User visits the Website, TarakHealth automatically receive the URL of the site from which such User came and the site or App to which such User is going when he/she/it leaves. TarakHealth also receives the Internet Protocol (IP) address of each User’s computer (or the proxy server a User used to access the World Wide Web), User’s computer operating system and type of web browser the User is using, email patterns, as well as the name of User’s ISP. This information is used to analyze overall trends to help TarakHealth improve its Service. The linkage between User’s IP address and User’s personally identifiable information is not shared with third parties without such User’s permission or except when required by law. Notwithstanding the above, TarakHealth may share some of the aggregate findings (not the specific data) with advertisers, sponsors, investors, strategic partners, and others in order to help grow its business.

8. The Website uses temporary cookies to store certain data (that is not sensitive personal data or information) that is used by TarakHealth and its service providers for the technical administration of the Website, App, research and development, and for User administration. In the course of serving advertisements or optimizing services to its Users, TarakHealth may allow authorized third parties to place or recognize a unique cookie on the User’s browser.
TarakHealth does not store personally identifiable information in the cookies.

9. We may also use the information you provide us to send you information about your order, additional information about the site, or information about special offers or products through us or our affiliated companies that you might be interested in receiving, unless you request not to receive such information. Our site uses “cookies” to help us identify you as a prior customer, retrieve information you provided previously, and otherwise personalize your interaction with our site. You should refer to your browser instructions or help menu if you would like information on whether your browser enables you to block cookies, receive a warning before a cookie is stored, or remove cookies from your computer's hard drive.

10. TarakHealth is not responsible for the content of any other third party site linked to this site or any other site through which you accessed TarakHealth, and you should refer to those sites for any applicable terms of use or their privacy or security policies.

11. If you need to update, modify, or change your information in our database or if you choose to opt- out of receiving future communications from us contact us by email at Arogyam360@gmail.com

6.11 The Website or App may enable User to communicate with other Users or to post information to be accessed by others, whereupon other Users may collect such data. Such Users, including any moderators or administrators, are not authorized TarakHealth representatives or agents, and their opinions or statements do not necessarily reflect those of TarakHealth, and they are not authorized to bind TarakHealth to any contract. TarakHealth hereby expressly disclaims any liability for any reliance or misuse of such information that is made available by Users or visitors in such a manner.

6.12 TarakHealth does not knowingly collect personal data from children.

6.13 TarakHealth does not collect information about the visitors of the Website from other sources, such as public records or bodies, or private organisations, save and except for the purposes of registration of the Users (the collection, storage and disclosure of which each End. User must agree to under the terms of use in order for TarakHealth to effectively render the services)

6.14 TarakHealth has implemented Indian legal industry standard security policies, rules and technical measures to protect the personal data that it has under its control from unauthorized access, improper use or disclosure, unauthorized modification and unlawful destruction or accidental loss.

6.15 TarakHealth will not disclose any personal information or data to governmental institutions or authorities unless such disclosure is requisitioned under any Indian law or judicial decree or when TarakHealth, in its sole discretion, deems it necessary in order to protect its rights or the rights of others, to prevent harm to persons or property, to fight fraud and credit risk, or to enforce or apply our terms of use.

6.16 TarakHealth addresses any discrepancies and grievances of all Users with respect to processing of information in a time bound manner. For this purpose, TarakHealth has designated “Ramesh Shah” as the Grievance Officer, who will redress the grievances of the Users expeditiously within a maximum of one month from the date of receipt of grievance, and who can be reached by:
i. Sending a letter marked to the attention of “Ramesh Shah” to Tarak Online Health Services LLP, 142/24 R. B. Marg, Ghodapdeo, India – 400 033; or
ii. Sending an email to  arogyam360@gmail.com.

B. Practitioners Note:

1. This section is applicable to Practitioners (“Practitioners”)

2. As part of the registration/application creation and submission process that is available to Practitioners on Website or App, certain information, including sensitive personal data or information is collected from the Practitioners.

3. All the statements in this privacy policy apply to all Practitioners, and all Practitioners are therefore required to read and understand the privacy statements set out herein prior to submitting any sensitive personal data or information to TarakHealth, failing which they are required to leave this Website immediately.

4. Practitioners personally identifiable information they choose to provide on the Website is used to help the Practitioners describe / identify themselves. This information is exclusively owned by TarakHealth. TarakHealth may use such information for commercial purposes and in an aggregated or non-personally identifiable form for research, statistical analysis and business intelligence purposes, and may sell or otherwise transfer such research, statistical or intelligence data in an aggregated or non-personally identifiable form to third parties and affiliates.

5. TarakHealth automatically lists Practitioners’ information on its Website/App for every ‘Doctor’ added to a Practice using its Software. The Practitioner information listed on Website/App is displayed when Patients search for doctors on Website/App, and the Practitioner information listed on Website/App is used by Patients to request for doctor Consultation. TarakHealth, on its own, does not list any Personally Sensitive Information of such Practitioners.

6. TarakHealth also creates Practitioners’ information for Practitioners that have not signed up or registered for TarakHealth Services. Such Practitioners are manually verified over phone or in person by TarakHealth or its associates, and TarakHealth makes every effort to capture accurate information for such Practitioners. However, TarakHealth does not hold any liability for any incorrect or incomplete information appearing on Website for such Practitioners.

C. Patients Note:

1. This section is applicable to Patients (“Patients”)

2. As part of the registration/application creation and submission process that is available to Patients on this website, certain information, including sensitive personal data or information is collected from the users.

3. All the statements in this privacy policy apply to all Patients, and all Patients are therefore required to read and understand the privacy statements set out herein prior to submitting any sensitive personal data or information to TarakHealth, failing which they are required to leave this Website/App immediately.

4. If you have inadvertently submitted any such information to TarakHealth prior to reading the privacy statements set out herein, and you do not agree with the manner in which such information is collected, stored or used, then you may access, modify and delete all information stored about you by TarakHealth by using options provided on the Website or App. In addition, any Patients can ask TarakHealth, by sending an email to arogyam360@gmail.com whether TarakHealth is keeping personal data about him/her, and every Patient is also entitled to require TarakHealth to delete and destroy all such information relating to him/her (but not other Users) in its possession.

5. Patients’ personally identifiable information they choose to provide on the Website is used to help the Patients describe/identify themselves. Other information that does not personally identify the Patients as an individual, is collected by TarakHealth from Patients (such as, patterns of utilization described above) and is exclusively owned by TarakHealth. TarakHealth may also use such information in an aggregated or non-personally identifiable form for research, statistical analysis and business intelligence purposes, and may sell or otherwise transfer such research, statistical or intelligence data in an aggregated or non-personally identifiable form to third parties and affiliates. If TarakHealth wishes to use any Patients’ personal data for a new purpose, it will seek Patients’ permission before doing so.

6. TarakHealth will communicate with the Patients through email, phone and notices posted on the Website/App or through other means available through the service, including text and other forms of messaging based on Patients contact preferences. The Patients can change their e-mail and contact preferences at any time though the account settings tab on their phone app.

7. At times, TarakHealth conducts a User survey to collect information about Patients' preferences. These surveys are optional and if Patients choose to respond, their responses will be kept anonymous. Similarly, TarakHealth may offer contests to qualifying Patients in which we ask for contact and demographic information such as name, email address and mailing address. None of this information is shared with third parties, except in summary form, if at all. The demographic information that TarakHealth collects in the registration process and through surveys is used to help TarakHealth improve its Services to meet the needs and preferences of Patients. This may include targeting advertising to Patients about our Services. Information we gather through a contest may also be disclosed to third parties, as necessary, for prize fulfillment and other aspects of any contest or similar offering.

8. TarakHealth may keep records of requests received on App and made for making appointments or other purposes for the purpose of administration of Services, research and development and for User administration.

9. All TarakHealth employees and data processors, who have access to, and are associated with the processing of sensitive personal data or information, are obliged to respect the confidentiality of every Patients’ sensitive personal data and information.

10. TarakHealth may also disclose or transfer Patients’ personal and other information a User provides, to another third party as part of reorganization or a sale of the assets of a TarakHealth corporation division or company. Any third party to which TarakHealth transfers or sells its assets will have the right to continue to use the personal and other information that Patients provide us.

11. Save as set out above, TarakHealth only uses the personal data or information collected from Patients in the manner set out in the section relating to “Registration Process” below. TarakHealth may also use such information in an aggregated or non-personally identifiable form for research, statistical analysis and business intelligence purposes, and may sell or otherwise transfer such research, statistical or intelligence data in an aggregated or non-personally identifiable forms to third parties and affiliates. If TarakHealth wishes to use any Patients’ personal data for a new purpose, it will seek such Patients’ permission before doing so.

12. To the extent necessary to provide Patients with the services on the Website, TarakHealth may provide their Personal Information to third party contractors who work on behalf of or with TarakHealth to provide Patients with such services, to help TarakHealth communicate with Patients or to maintain the Website. Generally these contractors do not have any independent right to share this information, however certain contractors who provide services on the Website, including the providers of online communications services, will have rights to use and disclose the Personal Information collected in connection with the provision of these services in accordance with their own privacy policies.

D. Casual Visitors Note:

1. No sensitive personal data or information is automatically collected by TarakHealth from any casual visitors of this website, who are merely perusing the site.

2. Nevertheless, certain provisions of this privacy policy are applicable to even such casual visitors, and such casual visitors are also required to read and understand the privacy statements set out herein, failing which they are required to leave this website immediately.

3. If you, as a casual visitor, have inadvertently browsed any other pages of this Website or App prior to reading the privacy statements set out herein, and you do not agree with the manner in which such information is obtained, stored or used, merely quitting this browser application should ordinarily clear all temporary cookies installed by TarakHealth. All visitors, however, encouraged to use the “clear cookies” functionality of their browsers to ensure such clearing /deletion, as TarakHealth cannot guarantee, predict or provide for the behaviour of the equipment of all the visitors of the Website.

4. You are not a casual visitor if you have willingly submitted any personal data or information to TarakHealth through any means, including email, post or through the registration process on the Website or App. All such visitors will be deemed to be, and will be treated as, End Users for the purposes of this privacy policy, and in which case, all the statements in this privacy policy

E.Change to privacy policy

1. The Users acknowledge that this privacy policy is part of the terms of use and unconditionally agree that becoming a User of the Website or App and its services signifies their assent to this privacy policy. User’s visit and any dispute over privacy is subject to this policy and terms of use. TarakHealth may update this privacy policy at any time, with or without advance notice. In the event, there are significant changes in the way TarakHealth to treats User’s personally identifiable information, TarakHealth will display a notice on the Website or send Users an email, as provided for above. Unless stated otherwise, TarakHealth’s current privacy policy applies to all information that TarakHealth has about Users and their account. Notwithstanding the above, TarakHealth shall not be required to notify the Users of any changes made to the privacy policy.

2. If a User uses the Service after notice of changes have been sent to such User or published on the Website, such User hereby provides his/her/its consent to the changed practices.

F.Registration Process

1. As part of the registration process, TarakHealth collects the following personal information

  • Name
  • UserId
  • Email address
  • Address (including country and ZIP/postal code)
  • Phone number
  • Password chosen by the User
  • Valid financial account information; and
  • Other details as the End User may volunteer.

2. All the information listed in F-1 of this privacy policy (“User Information”) is maintained by TarakHealth in electronic form on its equipment, and on the equipment of its employees. End User Information may also be converted to physical form from time to time. Regardless of the manner of storage, TarakHealth will keep all End User Information confidential, and will only disclose End User Information in the following manner:

3. TarakHealth makes all User Information accessible to its employees only on a need-to-know basis, and binds all such employees to strict confidentiality obligations.

4. Part of the functionality of the Software is assisting the doctors to maintain and organise such information. TarakHealth may, therefore, retain and submit all such records to the appropriate authorities, or to doctors who request access to such information.

5. Part of the functionality of the Software is assisting the patients to access information relating to them. TarakHealth may, therefore, retain and submit all such records to the relevant patients,

Notwithstanding the above, TarakHealth shall not be responsible for any breach of security or for any actions of any third parties that receive Users’ personal data or events that are beyond the reasonable control of TarakHealth including, acts of government, computer hacking, unauthorized access to computer data and storage device, computer crashes, breach of security and encryption, etc.

General Disclaimers

You acknowledge that your use of the Tarak Online Health Services LLP  is at your sole risk, and that you assume full responsibility for all risk associated therewith. All information, products or services contained on or provided through this App are provided "as is" and “as available” without any warranty of any kind, express or implied. To the fullest extent permissible under applicable law Tarak Online Health Services LLP and its partners, affiliates, directors, officers, managers, employees or other representatives (collectively, "affiliates") hereby disclaim all representations and warranties, express or implied, statutory or otherwise, including but not limited to warranties of merchantability, fitness for a particular purpose, title, non-infringement and freedom from computer virus strains. Without limiting the foregoing, Tarak Online Health Services LLP and its affiliates make no warranty as to the reliability, accuracy, timeliness, usefulness, adequacy, completeness or suitability of Tarak Online Health Services LLP products and services provided hereunder. Tarak Online Health Services LLP makes no representations or warranties about: the satisfaction of government regulations requiring disclosure of information on prescription drug products; or any treatment, action or application or preparation of medication based on information offered or provided through the Tarak Online Health Services LLP. Tarak Online Health Services LLP does not endorse the promotions, products, or services of any third parties. Tarak Online Health Services LLP does not warrant or validate the information of any third party advertisements, promotions, communications or other materials. Tarak Online Health Services LLP does not assume any responsibility or liability for the accuracy of information contained in this Site or any third party web sites.

Service Reliability and Warranties

Tarak Online Health Services LLP makes no warranty that the Services will meet your requirements, or that the Service(s) will be uninterrupted, timely, 100% secure, or error free, or that defects, if any, will be corrected. This includes loss of data resulting from delays, and any service interruption caused by Tarak Online Health Services LLP employees. Tarak Online Health Services LLP is not responsible for transmission errors or corruption or compromise of data carried over local or interchange telecommunication carriers.

Tarak Online Health Services LLP will take all necessary precautions to protect against failure of our equipment and software. The Customer acknowledges and agrees that temporary interruptions in service may occur, and that Tarak Online Health Services LLP shall have no liability for any claim, cost, charge, loss or expense arising from or relating to use of the Services. The Customer acknowledges and agrees that data may be lost or corrupted in connection with use of the Services. Tarak Online Health Services

LLP may perform regular back-ups of all data stored, but shall have no liability to Customer in the event all data is lost or destroyed. Customer acknowledges and agrees that in the event restoration of data from backup is necessary, it may take several days to complete such restoration of data and resume operation of the Services.


You agree to release, indemnify, defend and hold harmless Tarak Online Health Services LLP, our contractors, agents, employees, officers, partners and affiliates (Affiliates) harmless from all liabilities, claims, rights, losses, causes of action, actions and suits (no matter whether in law or in equity), expenses, including attorney's fees, of third parties relating to or arising, directly or indirectly, out of or in connection with
(i) your use or misuse of the App or the Services or any information posted on the Site,
(ii) Your breach of the Terms of Use or the Privacy Policy,
(iii) your relationship with any Provider,
(iv) the content or subject matter of or any information you provide to Tarak Online Health Services LLP, any of its Affiliates, any Provider or customer service agent, and/or (v) any negligent or wrongful action or omission by you in the use or misuse of the App or the Services or any information posted on the Site, including, but not limited to, infringement of third party intellectual property rights, privacy rights, or negligent or wrongful conduct. If and When Tarak Online Health Services LLP is threatened with suit by a third party, Tarak Online Health Services LLP may seek written assurances from you concerning your promise to indemnify it; your failure to provide those assurances may be considered by us to be a breach of your Terms of Use and may result in deactivation of your Tarak Online Health Services LLP account Service(s).

Limitation of Liability

Except as prohibited by law, and without limitation:

Tarak Online Health Services LLP shall not be liable for the acts or ommisions of any of the independent providers.

You shall be solely and fully responsible for any damage to Tarak Online Health Services LLP and its services or any computer system, any loss of data, or any improper use or disclosure of information on the services caused by you or any person using your user name or password.Tarak Online Health Services LLP does not assume any liability arising from the failure of any telecommunications infrastructure, or the internet or for misuse of any of the advice, ideas, inforamtion, instructions, or guidelines accessed through the services.

In no event shall Tarak Online Health Services LLP nor any of its affiliates be liable for any direct damages in excess of (i) the fees paid under your plan, or (ii) in the event no fees was paid or required, the liquidated sum of Rs. 250.00. In addition, to the maximum extent permitted by law, in no event shall Tarak Online Health Services LLP nor any of its affiliates be liable for any special, punitive, indirect, incidental or consequential damages, that result from (i) personal injury, wrongful death, loss of use, loss of profits, interruption of service or loss of data, or (ii) mistakes, omissions, interruptions, deletion of files, errors, defects, delays in operation or transmission or any failure of performance, whether or not limited to acts of god, communication failure, theft, destruction or unauthorized access to Tarak Online Health Services LLP or services, and whether in any action in warranty, contract (including, but not limited to negligence or fundamental breach), or otherwise arising out of or in any way connected with the use of, or the inability to use, this app or any service offered through this app or any material or information contained in, accessed through this app, even if an authorized representative of Tarak Online Health Services LLP is advised of the likelihood or possibility of the same. To the extent certain jursidictions restrict any of the above limitations of liability; such limitations shall not apply in such jurisdictions to the extent of such restrictions. You acknowledge and agree that Tarak Online Health Services LLP’s aggregate liability to you for any damages, losses, fees, charges, expenses or liabilities, and in circumstances where the foregoing limitation is finally determined to be unavailable shall not exceed the fees paid by you prior to the first occurrence of the subject damages, losses, fees, charges, expenses or liabilities.

Refund Policy: 

The client understands and agrees that all consultations cancelled once the call is initiated will be charged the full consultation amount / fees, said amount to be as set forth on the App.

As further consideration for the Services, you agree to provide certain current, complete and accurate
information about them, including valid credit card information, as required by the sign-up for Services and maintain and update this information as needed, to keep it current, complete and accurate. By completing and submitting the sign-up form, you represents that the statements in their application are true and accurate. Tarak Online Health Services LLP reserves the right to modify its' pricing structure at any time and implement the new price structure at any time prior to billing you for your payment pursuant to these Terms of Use. You understand that Services may not be provided or scheduled consultations cancelled if your credit card information is inaccurate or invalid.

If the payment is made and the doctor doesn’t call for consultation, then the person has to mail the complaint at grievenace@tarakhealth.com. On verification, the money will be refunded to his/her credit card/debit card from which the payment has been made within 7 working days.

Dispute resolution mechanism: 

The person has to send the complaint by email to grievenace@tarakhealth.com  The arbitrators
appointed by Tarak Online Health Services LLP will look into the matter and attempt resolve it to mutual satisfaction within 14 working days. Limitation of Liability. Notwithstanding anything in this agreement to the contrary, our aggregate liability under this agreement, regardless of theory of liability, shall be limited to the aggregate fees actually paid by you under this agreement for the two (2) days period preceding the event first giving rise to the claim.

Any dispute, claim or controversy arising out of or relating to this agreement or the breach, termination, enforcement, interpretation or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be subject to final and binding arbitration governed by The Arbitration and Conciliation Act, 1996. The arbitration shall be conducted before a single arbitrator in accordance with the commercial dispute resolution procedures and the supplementary procedures for consumer related disputes.  Judgment on the award may be entered in Mumbai court. This clause shall not preclude either party from seeking temporary or preliminary injunctive relief in connection with an arbitrable controversy, but only upon the ground that the award to which that party may be entitled may be rendered ineffectual without such provisional relief.

The parties agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff, class member, or private attorney general in any purported class, representative, or private-attorney-general proceeding. By entering into this agreement, you and we are each waiving the right to a court trial or to participate in a class action. The arbitrator may not consolidate more than one person’s claim with your claims or our claims and may not otherwise preside over any representative, class, or private-attorney-general proceeding. The arbitrator may award declaratory or injunctive relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party’s individual claim.

Any part of this agreement to arbitrate that shall prove to be invalid, void, or illegal shall in no way affect, impair, or invalidate any other provision of this agreement to arbitrate, and such other provisions shall remain in full force and effect.
